1.3 Separate Agreements: The actual provision of architectural or retrofit coordination services is governed by a separate, formal Letter of Appointment or Services Contract agreed upon between mwclubb and the client. In the event of any conflict between these Terms and your Services Contract, the Services Contract shall prevail.
2. Client Portal Registration and Security
2.1 Account Creation: To access the Client Portal, you will be required to register for an account using credentials provided by us or created by you.
2.2 Confidentiality: You are responsible for maintaining the confidentiality of your login credentials. You must not share your username or password with unauthorized third parties.
2.3 Unauthorized Access: You agree to notify us immediately at [info@mwclubb.co.uk] if you suspect any unauthorized use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to protect your login information.
3. Intellectual Property Rights
3.1 Ownership: All content on the Website and Client Portal—including but not limited to architectural designs, 3D models, Retrofit Plans, blueprints, text, graphics, logos, and software—is the exclusive property of mwclubb or our licensors and is protected by UK and international copyright laws.
3.2 Permitted Use: Clients are granted a limited, non-exclusive, non-transferable license to access and download project-specific documents from the Client Portal solely for the purpose of viewing and managing their specific project with us.
3.3 Restrictions: You may not copy, reproduce, distribute, publish, or commercially exploit any designs or content from our Website or Client Portal without our express written consent. Copyright in all architectural work remains with mwclubb unless expressly transferred in writing.
4. Acceptable Use and User Conduct
When using our Website and Client Portal, you agree that you will not:
Upload or transmit any viruses, malware, or destructive code.
Attempt to gain unauthorized access to the Client Portal, other users' accounts, or our underlying servers.
